Context

In recent years, the Government of India has taken significant steps to address the rights and needs of the LGBTQI+ community. Following a landmark Supreme Court ruling in October 2023, which recognized the rights of LGBTQI+ individuals, the government has initiated various measures aimed at safeguarding their interests and ensuring inclusivity. 

Supreme Court Directive and Government Response

  • Supriya vs Union of India was the judgment given by the Supreme Court of India in October, 2023 for the protection of the rights of LGBTQI+ community but the government failed to take required actions for the protection of the rights of this part of society.
  • According to this decision, The Ministry of Social Justice and Empowerment (MSJE) in April 2024 formed a high-level committee chaired by the Cabinet Secretary.
  • The main objective of this committee is to determine how the rights of the gay and lesbian citizens can be properly accorded and catered for through policies.

The Member Convenor is Secretary of the Department of Social Justice and Empowerment. This diverse composition will guarantee proper consideration of the various problematic issues affecting the members of the LGBTQI+ community.

Key Measures Implemented

The government has initiated several measures aimed at addressing the specific needs of the LGBTQI+ community. These measures include:

  • Ration Cards: The Department of Food and Public Distribution has released circulars in light of which states and Union Territories have been directed to accept partners in queer relationships as members of the same household for ration card. This action is to counter discrimination and ensure that the affected communities get an equal share of the available resources.
  • Banking and Financial Services: DFS has been clear that persons in the LGBTQI+ community are free to open joint bank accounts, or nominate their partners as beneficiaries. Thus, this policy change is extremely necessary as it impacts the future of the queer economy and security of queer relationships.
  • Healthcare Guidelines: The Ministry of Health and Family Welfare has brought out the policy to control Discrimination in health care facilities. What these guidelines also effectively rule out is conversion therapy while guaranteeing that all those who require sexual reassignment surgery can undergo it. This is a step forward in the right direction in which they will be able to prevent discrimination of transsexuals and protect their dignity in the medical facilities.
